We may update this Applicant Privacy Notice from time to time in our sole discretion. If we do, we’ll let you know by posting the updated Applicant Privacy Notice on the Jobs page of our website, and/or we may also send other communications.

2. PERSONAL INFORMATION WE COLLECT

We collect personal information that you provide to us, personal information we collect automatically when you interact with us, and personal information from third-party sources, as described below.

Providing personal information to us is voluntary. However, if you do not provide sufficient information, we may be unable to consider your application or, if you are hired, your subsequent promotion, transfer, or relocation.

A. Personal Information You Provide to Us Directly

We may collect personal information that you provide to us. Examples of this personal information include:

• Contact information, such as your work and home address, telephone number, email address and links to your online profile(s) that you may share with us;
• Information from job application materials or recruiters, such as your job application, resume or CV, cover letter, writing samples, references, work history, portfolios, whether you are subject to prior employer obligations, and information that referrers provide about you;
• Professional qualifications, such as licenses, permits, memberships, and certifications;
• Information from the application process, such as any phone screens, interviews, evaluations and outcomes of recruiting exercises;
• Immigration status and other information that would allow us to verify your employment eligibility;
• Biographical information, such as name, gender, date of birth, professional history, references, language proficiencies, education details, and information you make publicly available through job search or career networking sites;
• Job preferences, such as desired position and compensation and location preferences
• Employment history;
• Education information, such as education history (as part of a resume/CV or application form);
• Background check information, such as information necessary to complete background and/or other checks when permitted by law, and information received during these checks.
• Audio and/or visual information, such as through photographs used for identification purposes or when we video conference with you.
• Miscellaneous information. We may receive or collect other miscellaneous information (for example, information you choose to disclose during the interview process, whether in verbal or written form, and opinions or analysis generated during the application or interview process).
• “Equal Opportunity information” or “sensitive personal information.” In some circumstances and consistent with applicable law, we may collect or allow you to provide voluntarily certain “Equal Opportunity information” or “sensitive personal information” due to legal requirements, for other legitimate recruitment purposes, or for reporting purposes, including:
• Social Security Number, driver’s license number, or state identification card;
• Preferred pronouns;
• Criminal history data; and
• Information needed to understand and assess accommodation requests regarding potential disabilities or other health conditions.

B. Personal Information Collected Automatically

We may collect personal information from you automatically. For example:

• Device Information. When you use our website, we may collect personal information about your device, such as your internet protocol (IP) address, user settings, cookie identifiers, other unique identifiers, browser or device information, Internet service provider, and location information (including, as applicable, approximate location derived from IP address and precise geo-location information).

• Usage Information. We may collect personal information about your use of our website, such as the pages that you visit, items that you search for, the types of content you interact with, information about the links you click, the frequency and duration of your activities, and other information about how you use our website.

C. Personal Information Collected from Third Parties

We may collect personal information about you from third parties, including through publicly available sources and through third-party services and organizations to supplement information provided by you. For example, where permitted by law, we may collect results and outcomes from historic and ongoing background checks (including criminal record checks and credit reports) or contact the references you provided to verify your previous work history and performance. We may also collect social media information that is publicly available or that we are otherwise able to obtain.

3. HOW WE USE PERSONAL INFORMATION

We use personal information for a variety of business purposes, including for recruitment management, for administrative purposes, and with your consent, as described below.

A. Recruitment Management

We use personal information in connection with the overall management of our recruitment process. Examples of these activities may include, but are not limited to:

• Operating our website;
• Recruiting, interviewing and evaluating Applicants;
• Conducting background checks and other pre-employment screening (where permitted by law)
• Analyzing and improving our application and recruitment processes;
• Accommodating disabilities or health conditions;
• Communicating with you regarding your candidacy, opportunities with Metabase or about our website and any changes to applicable terms or policies; and
• Performing other business operations.

B. Administrative Purposes

We use personal information for various administrative purposes, such as:

• Complying with or monitoring compliance with legal and other requirements, such as reporting and equal opportunities monitoring requirements, where applicable;
• Complying with internal policies and procedures;
• Complying with lawful requests and legal process, such as to respond to subpoenas or requests from government authorities;
• Protecting our, your or others’ rights, safety and property;
• Investigating and deterring against fraudulent, harmful, unauthorized, unethical or illegal activity, or conduct in violation of our policies or procedures;

• Creating anonymous, aggregated, and/or de-identified data.

C. With Your Consent or Direction

We may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information, with your consent, or as otherwise directed by you.

D. Automated Decision Making

We may engage in automated decision making, including profiling. For example, we may use automated decision-making tools to help us summarize the contents of resumes. However, when we do this, there is always a human being involved in the review of these summaries, and the final decision on what action will be taken regarding the candidate’s application with Metabase. Metabase’s processing of your personal information will not result in a decision based solely on automated processing that has a legal or other similarly significant effect on you unless such a decision is necessary as part of a contract we have with you, we have your consent, or we are permitted by law to engage in such automated decision making.

4. HOW WE DISCLOSE PERSONAL INFORMATION

We disclose personal information to third parties for a variety of business purposes, including to operate our business, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below.

A. Disclosures to Operate Our Business

• Service Providers and Professional Advisors. Your personal information may be shared with service providers and professional advisors.

• Affiliates. We may share your personal information with our corporate affiliates.

• Third-Party Services You Share or Interact With. As part of your relationship with Metabase, you may interface, interact, share information with, direct us to share information with, access and/or use third-party websites, applications, services, products, and technology (each a “Third-Party Service”).

Any personal information shared with a Third-Party Service will be subject to the Third- Party Service’s privacy policy. We are not responsible for the processing of personal information by Third-Party Services.

B. Disclosures to Protect Us or Others

We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

C. Disclosure in the Event of Merger, Sale, or Other Asset Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy or dissolution, receivership, purchase or sale of assets, transition of service to another entity, or other similar corporate transaction, your personal information may be disclosed, sold, or transferred as part of such a transaction.

5. YOUR PRIVACY CHOICES

The privacy choices you may have about your personal information are described below.

• “Do Not Track.” Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

6. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

All personal information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. These countries may or may not have adequate data protection laws as defined by the data protection authority in your country.

If we transfer personal information from the European Economic Area, Switzerland, and/or the United Kingdom to a country that does not provide an adequate level of protection under applicable data protection laws, one of the safeguards we may use to support such transfer is the EU Standard Contractual Clauses.

7. RETENTION OF PERSONAL INFORMATION

We store the personal information we collect as described in this Applicant Privacy Notice for as long as necessary to fulfill the purpose(s) for which it was collected, operate our business, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

To determine the appropriate retention period for personal information, we may consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, certain risk factors, the purposes for which we process your personal information, and whether we can achieve those purposes through other means.

8. SUPPLEMENTAL NOTICE FOR EU/UK GDPR

This Supplemental Notice for EU/UK GDPR only applies to our processing of personal information that is subject to the EU or UK General Data Protection Regulation.

In some cases, providing personal information may be a requirement under applicable law, a contractual requirement, or a requirement necessary to enter into a contract. If you choose not to provide personal information in cases where it is required, we will inform you of the consequences at the time of your refusal to provide the personal information.

• Request Deletion of Your Personal Information.
• Request Restriction of or Object to Our Processing of Your Personal Information.
• Withdraw Your Consent to Our Processing of Your Personal Information. Please note that your withdrawal will only take effect for future processing and will not affect the lawfulness of processing before the withdrawal.
• Lodge a Complaint with the Competent Supervisory Authority if you believe our processing of your personal information violates applicable law.
